Article 1: Object

These conditions govern the sale of old safes by CoffreFortVintage.com (EDT Serrures / 14 A Avenue Barthelemy Thimonnier 69300 Caluire et Cuire)

Article 2 : Price

The sale prices indicated on the site are expressed in euros and are inclusive of VAT, the applicable VAT is at the rate of 20% and excluding processing and shipping costs. All orders, whatever their origin, are payable in euros. CoffreFortVintage.com reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the tariff in force at the time of the validation of the order. The products remain the property of CoffreFortVintage.com until full payment of the price. When ordering to a country other than mainland France, you are the importer of the product (s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of CoffreFortVintage.com. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in the country concerned. We advise you to find out about these aspects from your local authorities.

Article 3 - Order and validation of order

All orders are made as follows: after a telephone contact or by e-mail, CoffreFortVintage.com sends the customer an order form in French specifying the product ordered, its characteristics, its price and the delivery conditions. The buyer's acceptance is then materialized by the signing of this order form sent to CoffreFortVintage.com (e-mail or post). If there is a delay between the order and the availability of the product purchased for the carrier, a deposit of 10% of the total price is required. It is then the actual payment of the balance to be paid which will trigger the delivery. CoffreFortVintage.com reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received. Any order from CoffreFortVintage.com implies acceptance of these General Conditions. Any order confirmation entails your full acceptance of these general conditions of sale, without exception or reservation. All the data provided and the confirmation recorded will constitute proof of the transaction. You declare that you are fully aware of it.

Article 4 - Payment

CoffreFortVintage.com provides the buyer with several payment methods for paying for an order: bank check issued in France or bank transfer. In the event of payment by check, the order is only taken over when the check is cashed and subject to the bank delay. In the event of payment by bank transfer, your order is processed after validation (approximately 48 hours) of your payment order. The fact of validating your order implies for you the obligation to pay the indicated price. In all cases, any bank charges and other exchange costs (in the context of a payment from abroad, for example) are the sole responsibility of the customer.

Article 5 - Withdrawal

In accordance with the provisions of article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify reasons or to pay penalty. Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal. Return costs are the responsibility of the customer who wants to exercise his right of withdrawal. In the event of exercise of the right of withdrawal, CoffreFortVintage.com will reimburse the sums paid, within 14 days of receipt of the complete package in return and without damage, and via the same means of payment as that used during the command. Exceptions to the right of withdrawal: in accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal cannot be exercised for contracts:

1 ° Provision of services fully executed before the end of the withdrawal period and the execution of which has started after the express prior agreement of the consumer and express waiver of his right of withdrawal;

2 ° Supply of goods or services whose price depends on fluctuations on the financial market beyond the control of the professional and likely to occur during the withdrawal period;

3 ° Supply of goods made according to the consumer's specifications or clearly personalized;

4 ° Supply of goods liable to deteriorate or expire quickly;

5 ° Supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;

6 ° Supply of goods which, after having been delivered and by their nature, are mixed inseparably with other articles;

7 ° Supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on fluctuations on the market beyond the control of the professional;

8 ° Maintenance or repair work to be carried out urgently at the consumer's home and expressly requested by him, within the limit of spare parts and work strictly necessary to respond to the emergency;

9 ° Supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery;

10 ° Supply of a newspaper, periodical or magazine, except for subscription contracts to these publications;

11 ° Concluded during a public auction;

12 ° Provision of accommodation services, other than residential accommodation, goods transport services, car rentals, catering or leisure activities which must be provided on a specific date or period;

13 ° Supply of digital content not supplied on a material support, the execution of which has started after the express prior agreement of the consumer and express waiver of his right of withdrawal.

NOTE: In accordance with article 34 of law n ° 2014-344 of March 17, 2014, these provisions introduced by article 9 of said law apply to contracts concluded after June 13, 2014.

Article 6 - Delivery

The products are delivered to the delivery address indicated during the ordering process, within the period indicated on the order form. Delivery times are given for information only. The delivery will be made by carrier and will require a quotation on a case by case basis. In all cases, CoffreFortVintage.com is released from its delivery obligations in the event of force majeure: fire, flood, strikes or reasons beyond its control. Upon receipt of the goods ordered, the recipient must check the condition of the package and the general appearance of the goods contained inside. In the event of loss or damage, it must make precise and detailed written reservations on the carrier's delivery note in the presence of the carrier or its employees; he must then send him a registered letter indicating the reservations, within three days of delivery. The goods accepted without reservation by the recipient at the time of delivery and in the absence of a letter sent to the carrier within three days, is deemed to have arrived in good condition and in its entirety. No claim can be supported by CoffreFortVintage.com and its responsibility cannot be engaged. Please note: as soon as the customer takes physical possession of the products ordered, the risk of loss or damage to the products is transferred to him.

Article 7 - Guarantee

All products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided for in articles 1641 and following of the Civil Code. However, CoffreFortVintage.com reminds its customers that the safes sold via the site www.CoffreFortVintage.com are antiques and collectibles, with all the precautions of use that this imposes, and that they are notably not intended for professional use.

Article 8 - Liability

The products offered comply with current French legislation. The responsibility of CoffreFortVintage.com cannot be engaged in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products you plan to order. Article 9 - Applicable law in the event of disputes

The language of this contract is French. These conditions of sale are subject to French law. In the event of a dispute, the French courts will be the only competent and it is the Commercial Court of Lyon (69) which is designated as competent jurisdiction and will settle any dispute.

Article 10 - Intellectual property

All elements of the site www.CoffreFortVintage.com are and remain the intellectual and exclusive property of CoffreFortVintage.com. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site whether software, visual or audio. Any simple link or hypertext is strictly prohibited without the express written agreement of CoffreFortVintage.com.

Article 11 - Personal data

CoffreFortVintage.com reserves the right to collect nominative information and personal data concerning you. They are necessary for the management of your order, as well as for the improvement of the services and information that we send to you. They can also be sent to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations. Article 12 - Proof Archiving

CoffreFortVintage.com will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
